Where a written specification for the appearance of a feature is provided to the contractor, it is the responsibility of the client or agent to request a small sample of this finished works prior to the start of that specific feature. The contractor is not liable for any works necessary as a consequence of such an omission. This applies to both client and agent.

Plant Warranty
McBrayer Landscapes recommends that the Client hire a professional service to care for the newly installed plants by providing fertilization and applications to prevent insect damage and disease. McBrayer Landscapes also recommends hiring a professional to make scheduled visits to adjust your watering schedule for seasonal conditions. These services will ensure that your new plants thrive and not just survive. These services will also provide you with the peace of mind that you will minimize negligence in care and watering. McBrayer Landscapes can provide a separate quote for these services.
McBrayer Landscapes does not include any soil amendments or soil conditioner in the plant installation pricing unless requested by the Client. These will be listed as a separate line item on the estimate if included in pricing.
It is the Client's responsibility to review each plant variety prior to signing contract. Pictures above are just an example to provide the client a visual aid. Once plants are purchased, any substitutions will require a change order and additional fees will apply.
Example plant sizes above are:
#1 - 1 gallon plant container
#2 - 2 gallon plant container
#3 - 3 gallon plant container
#5 - 5 gallon plant container
#7 - 7 gallon plant container
#15 - 15 gallon plant container
Plant Substitutions: There is always the possibility that one or more plants on the plant list will not be available when the project begins. If this happens, McBrayer Landscapes will substitute another suitable plant to replace the ones not available on the list. This may or may not impact the final price. McBrayer Landscapes reserves the right to adjust the contract price as needed when this occurs.
McBrayer Landscapes does not guarantee the above ground plant size (height or width) unless specified in the estimate. Plant sizes are sold as plant container sizes which hold the root ball. B&B plants will typically have a height listed. These heights can be slightly taller or slightly shorter than specified.
Tree staking is only provided at the discretion of McBrayer Landscapes. McBrayer Landscapes will include tree staking in areas where wind may be an issue. If Client requests tree staking, it will be an additional charge.
Client agrees to contact McBrayer Landscapes if they have any questions regarding the plants and their condition.
All perennial plants and shrubs are warrantied for 1 years from the date of installation provided the Client has a functioning
irrigation system with adequate coverage and takes proper care of the plants, including, but not limited to, providing water,
fertilizer, and insect and disease control. It is the Client's responsibility to ensure that all plants receive adequate water for seasonal conditions. If certain plants are not to be covered by warranty, they are identified as such on the project’s plant list or in this section below. Plants replaced under warranty will be the same size they were when they were installed.
Client acknowledges that by watering plants, their water bill may increase significantly. A light rainfall is not significant enough to skip a day of watering.
Client agrees to inspect all new plants daily for the first 60 days, every 2-3 days after the first 60 for the first year, and once each week thereafter. Client will observe plants for damaging insect activity, disease, discoloration, drought stress, or any other issues. Plants do not suddenly turn brown and die. If McBrayer Landscapes is called for a warranty inspection and finds the plant completely brown, McBrayer Landscapes may deny the warranty for that plant. If any serious discoloration is observed, please contact McBrayer Landscapes as soon as possible. Pictures can be emailed or text to us to get quick answer.
Client will notify McBrayer Landscapes immediately if any issues arise or if Client has questions regarding care.
Client acknowledges that they will adjust the watering schedule for the irrigation system regularly to accommodate seasonal conditions. Failure to adjust watering settings will void warranty. If Client is unsure of how to properly set the irrigation controller, Client can contact McBrayer Landscapes to ask questions on how to properly set and adjust the watering schedule or have McBrayer Landscapes set the watering schedule for them for a separate fee (Typically a $50 to $100 fee applies).
McBrayer Landscapes guarantees that all plants (including shrubs, trees and flowers) are healthy at the time of installation and assumes that the client will provide reasonable care to such plants. In the event that a plant dies, McBrayer Landscapes will replace the plant, subject to the following terms:
One full year, one time replacement – if and only if an irrigation system is present, and scheduled to run.
No warranty is given for plants not covered by irrigation or inadequately covered by irrigation. There may be
additional costs to make modifications to an existing irrigation system. An additional fee may also apply to inspect an existing irrigation system for adequate coverage.
Frequently, plants go into shock in the first season and may look somewhat unhealthy. We suggest you cut it back and fertilize it with Miracle Grow to give it a second chance before we replace it.
With all plant installations, the first time McBrayer Landscapes replaces a plant under the warranty, the labor and materials are free of charge. For each subsequent visit within the warranty period, the plants are free of charge but there will be a delivery fee. We advise clients to wait until close to the end of the warranty period, if possible, to schedule any and all replacements.
McBrayer Landscapes reserves the right to inspect all plants installed and conditions at anytime or plants in question when a warranty replacement request is made by Client. Plant warranty can be voided for certain plants or an entire project.
Plant warranty will be voided if:
-
Irrigation settings are tampered with and plants are not watered, underwatered, or overwatered for any period of time.
-
Plants are damaged by pets. This includes pets urinating on plants.
-
McBrayer Landscapes is not liable for replacing plants that perish due to any malfunctions of the irrigation system. Client agrees to make regular checks of their irrigation system to ensure that it is functioning properly and adequately covering plant material.
-
Any plants which were originally installed by McBrayer Landscapes, then subsequently repaired, adjusted, moved, or modified by an individual or entity other than McBrayer Landscapes.

McBrayer Landscapes provides clients will all pertinent information to care for new sod and seed. After seeding or sodding, no guarantee of lawn being free of weeds is offered. When new sod or seed is installed, often the soil is disturbed and weed seeds in the soil may begin to germinate, even if the sod has been treated. McBrayer Landscapes encourages the Client to hire a professional lawn care applicator to care for the new lawn. McBrayer Landscapes can provide a lawn treatment program for your new lawn under a separate quote. McBrayer Landscapes recommends not using any preemergent on new sod for a full year period and at least 60 days for new seeded lawns. McBrayer Landscapes will set your sprinkler system to water for the current seasonal conditions but it will be the responsibility of the Client to adjust the watering schedule as seasonal conditions change throughout the year. McBrayer Landscapes can make scheduled trips to properly set your watering schedule for you for an additional fee.

McBrayer Landscapes covers all irrigation system components for three full years from installation. It is recommended that the client perform visual checks of drip irrigation and basic adjustment of sprinkler heads, as needed, to ensure system is working as specified. Warranty is void if the system is not winterized and pipes freeze. Damage caused to the irrigation system from digging or lightening is not covered under warranty. Irrigation system repairs made by McBrayer Landscapes are also covered for a full three years. McBrayer Landscapes can provide a separate quote for this service.
Drainage Systems Warranty
McBrayer Landscapes covers all drainage systems for five full years. French drains are excluded from any warranty due to the nature of the native soil in Georgia. Client is responsible for cleaning the catch basin, and ensuring it is free from dirt and debris. McBrayer Landscapes only takes care of surface area water problems from rain and takes no responsibility if water enters the house from sub floors below the level of the soil. McBrayer Landscapes does not warranty drainage system problems due to settling or issues resulting from silt or debris entering the drainage system.
